Burst & Apple Sign Agreement in Principle to Settle CaseSANTA ROSA, CA –Marketwire– Nov 21, ‘07 — Burst.com today announced today that it has signed an agreement in principle to settle its case against Apple ending almost 2 years of litigation. Apple agreed to pay Burst a one-time payment of $10 million cash in exchange for a non-exclusive license to Burst’s patent portfolio, not including one issued U.S. patent and 3 pending U.S. patent applications related to new DVR technology. Burst agreed not to sue Apple for any future infringement of the DVR patent and any patents that might issue from the pending DVR-related applications.

The $10 million patent license provides Apple with the right to use Burst’s intellectual property in its own technology and products, without further consideration. Burst, however, retains the right to enforce its patent portfolio against others.

Court costs, expenses and attorney’s fees in connection with the settlement of the litigation with Apple will reduce proceeds to the Company to approximately $4.6 million. According to the agreement, payment to Burst is to be made promptly after signing of a definitive settlement agreement. Burst’s Board of Directors has indicated that it will be considering a cash distribution to Burst’s shareholders from the Apple license fee, in an amount to be determined. Apple Q4 Profit Jumps 67% On Strong Mac Sales

Apple LogoApple Inc beat Wall Street targets with a 67 percent rise in quarterly profit on Monday, led by strong sales of its Macintosh computers and a big first full quarter from the iPhone, sending its shares up nearly 6 percent.

CUPERTINO, California—October 22, 2007—Apple® today announced financial results for its fiscal 2007 fourth quarter ended September 29, 2007. The Company posted revenue of $6.22 billion and net quarterly profit of $904 million, or $1.01 per diluted share. These results compare to revenue of $4.84 billion and net quarterly profit of $542 million, or $.62 per diluted share, in the year-ago quarter. Gross margin was 33.6 percent, up from 29.2 percent in the year-ago quarter. International sales accounted for 40 percent of the quarter’s revenue.

Apple shipped 2,164,000 Macintosh® computers, representing 34 percent growth over the year-ago quarter and exceeding the previous quarterly record for Mac® shipments by 400,000. The Company sold 10,200,000 iPods during the quarter, representing 17 percent growth over the year-ago quarter. Quarterly iPhone™ sales were 1,119,000, bringing cumulative fiscal 2007 sales to 1,389,000.

“We are very pleased to have generated over $24 billion in revenue and $3.5 billion in net income in fiscal 2007,” said Steve Jobs, Apple’s CEO. “We’re looking forward to a strong December quarter as we enter the holiday season with Apple’s best products ever.”

“Apple ended the fiscal year with $15.4 billion in cash and no debt,” said Peter Oppenheimer, Apple’s CFO. “Looking ahead to the first quarter of fiscal 2008, we expect revenue of about $9.2 billion and earnings per diluted share of about $1.42.”

Universal Plans ‘Total Music’, In Talks For Free Music Partnership

Universal Music Group LogoSony BMG Music LogoWarner Music Group Logo“Universal Music Group is in discussions with other major labels to launch an online music subscription service that will be initially free with some digital players, a source familiar with the talks said on Monday.” Reuters is further reporting, “Called Total Music, the service is aimed at boosting Universal’s digital media revenue as CD sales plummet, the source said. It could also help reduce the leverage that Apple Inc has on the digital music market.”

On the same story InformationWeek writes, “The company is working with other major record labels, mobile device manufacturers, and wireless providers to give deliver music in a new way, according to a report on BusinessWeek.com. The move is the latest in a series of developments by the recording industry to shore up profits and regain control they have lost as consumers transition to downloading music — both through iTunes and piracy.”

For now, only 15 icons can be added this way–the last spot appears to be reserved for iTunes. The apps have been tested and are working fine.

He has also tracked down an option for International capabilities in SpringBoard, which may lead to foreign language Application support. This will be needed in countries like Germany and France, where the iPhone will shortly debut.”

intel-inside-iphone.jpgDigitimes is reporting according to its OEM sources, ” Apple reportedly is considering adopting Intel’s Moorestown MID (mobile Internet device) platform processor in a new iPhone, according to OEM sources.

Intel revealed a Moorestown-based MID product with functions similar to Apple’s iPhone at the recent Intel Developer Forum (IDF) San Francisco. The Moorestown platform is expected to launch in 2009 and Apple is considering developing an iPhone based on it, stated the sources.

Some channel vendors think that if Apple adopts Intel’s platform in its iPhone, it will reposition the MID market place and affect both notebook and handset markets.”

Wired adds to the story, “Moorestown will be based on Intel’s much-hyped 45nn manufacturing process, that could mean your future iPhone will see an exponential boost in power-efficiency (both in active and idle modes) and performance. Good news considering Moorestown will also likely support 3G (HSDPA), Wi-Fi, and WiMax.

Electronista also notes that the processor change would also bring the iPhone’s software closer in step with that of the company’s Mac computer range.”

Microsoft Unveils 4, 8 & 80 GB Zunes, Zune Social

The company also said three new models of Zune portable digital media players: a sleek, black Zune 80GB hard-drive model, which has a bright 3.2-inch screen and comes with premium headphones (ERP $249.99; all prices are U.S.); the ultraportable Zune 4GB (ERP $149.99); and Zune 8GB (ERP $199.99) flash models, both available in pink, green, black and glossy red. The new Zune devices feature the Zune Pad navigation button, with its touch-sensitive surface.
