RealPlayer Labeled as ‘Badware’ by StopBadware.org

At Last !!!  Finally StopBadware.org brought the Real Malware, RealPlayer from RealNetworks, to the light of the day.

StopBadware has brought just some of the bad practises out in the open, while you can find about it in much more details in reader comments I’ve found on highly recognized technology sites like CNET’s News.com, tehRegister.co.uk and PCWorld.com, posted by their tech savvy readers.

Just in case, if you are wondering who / what is this StopBadware.org ?
Stopbadware, an industry-academia group designed to raise public awareness about software that violates fair information and privacy practices, is a collaboration between Harvard Law School’s Berkman Center for Internet & Society and Oxford University’s Oxford Internet Institute, with support from companies like Google, Lenovo, and Sun Microsystems.

Cambridge, MA — StopBadware.org, the consumer protection initiative developed to combat badware, on Jan 31, released an alert about RealNetworks Inc.’s RealPlayer software application.

The group found RealPlayer version 10.5 to be badware because of inadequate disclosure of advertising behavior and RealPlayer version 11 to be badware because it bundles an additional application without disclosure.

RealPlayer 11 is the current version of the application, offered on Real (dot) com as an internet video and multimedia player. RealPlayer 10.5 is an older version which is still widely distributed through such sites as BBC Radio and through the Firefox web browser’s “missing plug-in” capability.

The report highlights two areas of concern:
• The Software does not fully, accurately, clearly, and conspicuously disclose the principal and significant features and functionality of the application prior to installation - The advertising software bundled with RealPlayer is misleadingly called a ‘message center’, and is described incompletely and inconspicuously in the EULA as software designed to provide useful software updates. When RealPlayer 10.5 is installed, the advertising features of this ‘message center’ are enabled by default for users who choose not to register their personal information with RealNetworks after the software is installed.
• Software installs deceptively - RealPlayer 11 does not disclose that it installs Rhapsody Player Engine, and does not remove this software when RealPlayer is uninstalled. Users are not informed by the installer or uninstaller of the connection between RealNetworks and Rhapsody Player Engine.

“Software producers have a responsibility to inform users, clearly and unambiguously, about what software will be installed on their computers and what it will do,” said Maxim Weinstein, manager of StopBadware.org at the Berkman Center for Internet & Society at Harvard Law School. “RealNetworks does not allow users to make an informed choice about how their computers will be used. We hope to see a new version of RealPlayer soon that addresses these

According to StopBadware.org’s definition of badware it is “malicious software that tracks your moves online and feeds that information back to shady marketing groups so that they can ambush you with targeted ads.”

“I installed RealPlayer’s suite once as an experiment and signed up to Rhapsody for their 30 day trial. I immediately changed my mind, but was unable to cancel using their website. After repeated emails and phone call attempts, I had to change my credit card number to stop the $19 / month in charges that had continued for 6 months. These people are either incompetent or crooks.”

I used to work for a retailer, in their service center, and I would regularly get in computers that the complaint was “Choppy DVD playback” or words to that effect. In most cases a quick uninstall of RealPlayer would fix it right up. Only PH would be foolish enought to install RealPlayer.”

Finally, I never get that, when there are choices of free Windows Media Player 11 and Open Sourced VLC Media Player, why in the world any one need to use RealPlayer? Ok how to play the contents that are available only in Real Media ? I just never play those files :)

Sweden Hits Pirate Bay with Legal ActionFeb 01, `08 — Four men who run one of the most popular file-sharing sites in the world have been charged with conspiracy to break copyright law in Sweden, the BBC reported on Thursday.

Pirate Bay does not store music and video files on its own servers, but instead helps users share them on the internet. The website acts as a directory of the files used by the BitTorrent file-transfer protocol.

“It’s not merely a search engine. It’s an active part of an action that aims at, and also leads to, making copyright protected material available,” public prosecutor Hakan Roswall told Reuters. “It’s a classic example of accessory — to act as intermediary between people who commit crimes, whether it’s in the physical or the virtual world.”

Pirate Bay told the news agency that the people running the site cannot be held responsible for how its directory services are used. The website is said to have between 10 and 15 million users around the world and is supported by online advertising.

Police seized computers in May 2006, temporarily shutting down the website.

Prosecutor Hakan Roswall said the website was commercially exploiting copyright-protected work because it was financed through advertising revenues. According to the Pirate Bay website, its users are currently downloading close to a million files.

On the site, a statement says: “In case we lose the pending trial (yeah right) there will still not be any changes to the site.

“The Pirate Bay will keep operating just as always. We’ve been here for years and we will be here many more.”

In an interview with the BBC’s technology programme Click last year Pirate Bay co-founder Peter Sunde said: “I think it’s okay to copy. They get their money from so many places that the sales is just one small part.”

The other three men facing charges are Carl Lundstrom, Frederik Neij and Gottfrid Svartholm Warg. If convicted, the four men could face a maximum of two years in prison.

The website had up until 2006 based its servers in Stockholm, but moved some to the Netherlands after a raid in May of that year by Swedish police, who seized equipment and held three people for questioning “on suspicion of breaking copyright law or abetting the breaking of copyright law,” authorities said. The site was taken down for a day, but was soon up and running again.

Moves against the site have been backed by entertainment industry groups, including the Motion Picture Association of America and the International Federation of the Phonographic Industry. More at BBC News.

Through a technique dubbed “Go Fighting Tabby!”, or GFT for short, you can gain root access on an Archos 605 wi-fi running 1.7.13 firmware and execute arbitrary programs in its embedded Linux environment.

This is the first step to gain access to the running Linux operating system, which until now has not been possible.

Using the GFT technique, you can install the ‘ARCwelder’ package which will allow you to ssh into the Archos 605 wi-fi and run unix commands from a shell.

Currently ARCwelder only provides an ssh package, however in time more packages may be included as they are tested and verified as working, some customization is necessary to ensure that they work on the embedded system, so the term ‘hack’ is definitely applicable.

Wal-Mart Shuts Online Movie DownloadsLittle Rock, AR — The world’s biggest retailer, Wal-Mart, has closed its video downloading service less than a year after it started selling films online.

The retreat for Wal-Mart, which accounts for about 40 percent of all DVD sales, follows the company’s 2005 decision to abandoned efforts to build an online DVD rental service. The world’s largest retailer instead turned its rental service over to Netflix.

It stopped the service on Dec 21, according to a message on the discount chain’s video download website. Wal-Mart said the decision had been forced by Hewlett-Packard withdrawing the software running the site.

The move ends a challenge to Apple’s iTunes store, Amazon and Netflix to win customers who rent films over the web.

The market for online video downloads has become very competitive with video rental chain Blockbuster buying Movielink over the summer to expand into this area.

In the fourth quarter of fiscal 2007, Adobe achieved record revenue of $911.2 million, compared to $682.2 million reported for the fourth quarter of fiscal 2006 and $851.7 million reported in the third quarter of fiscal 2007. This represents 34 percent year-over-year revenue growth. Adobe’s fourth quarter revenue target range was $860 to $890 million.

Adobe benefited from global demand for Creative Suite 3, which includes software for editing photos, designing Web sites and creating video. Chief Executive Officer Shantanu Narayen, who took over from Bruce Chizen this month, predicted first- quarter earnings that topped estimates, and reaffirmed a forecast for 13 percent sales growth in 2008.

Time Warner Gets Statewide Cable Franchise in OhioOn Friday, Dec 14, Ohio Commerce Director Kimberly Zurz granted statewide video-service authorization to Time Warner Cable LLC.

The company became the second enterprise to receive the 10-year, state-issued authorization, which was established by Ohio’s video-service law that went into effect September 24, 2007. AT&T Ohio was granted state video-service approval on November 7, 2007.

Time Warner Cable’s authorization covers 260 communities in 60 counties.

On June 25, 2007, Governor Ted Strickland signed Senate Bill 117, which created the one-stop, statewide video-service authorization process. Previously, cable or wire video-service companies had to negotiate local franchises with each municipality or township.

The law requires the Director of Commerce to administer the video-service authorization program. The Director also has the authority to investigate any allegation that a state-approved, video-service provider violated or failed to comply with the law.

The law includes a number of consumer protections. Providers with state-issued authorization are required to give customers:

Credit for a day’s rate if service is lost for more than four hours in any day.

* 30 days notice before removing a channel.
* 30 days notice prior to a rate increase.
* 10 days notice before disconnecting service.

Providers with state-issued authorization also must restore service in most cases within 72 hours after a subscriber reports a service interruption or other problem, and the companies cannot disconnect a customer’s video service for nonpayment before a bill is at least 45 days past due. A Canadian Man Receives $85k Mobile Phone BillDec 13, `07 — A Canadian man has been shocked to receive a mobile phone bill for nearly $85,000, BBC News reports.

The 22-year-old oil-field worker from Calgary, Piotr Staniaszek thought he could use his new phone as a modem for his computer under his $10 unlimited mobile browser plan from Bell Mobility.

He downloaded high-definition movies and other large files unaware that this incurred massive extra charges. Bell Mobility has since lowered the bill to $3,243, but Staniaszek says he intends to fight the charges anyway.

“The thing is, they’ve cut my phone off for being like $100 over,” he told CBC News. “Here, I’m $85,000 over and nobody bothered to give me a call and tell me what was going on.”

Bell Mobility said they would lower the bill to $3,243 in a “goodwill gesture” to match the best data plan available for using mobile phones as a modem, the Globe and Mail reported. More at BBC News.

London — Nov 27, ‘07 — The BBC, ITV and Channel 4 are to launch a joint on-demand service, which will bring together hundreds of hours of television programmes in one place, BBC News said on Tuesday.

The service is set to go live in 2008 and will offer viewers access to current shows and archive material. Plans will have to be approved by the BBC Trust and the other broadcasters’ boards, and a name for the service will be unveiled ahead of its launch.

The three broadcasters currently offer their own separate on-demand services.

The BBC’s iPlayer, ITV’s catch-up service and Channel 4oD will continue to exist along the new online “aggregator”, which will provide a complement to the established providers.

Programming from all three broadcasters will be available for free download, streaming, rental and purchase via the internet, with expansion on to other platforms planned.

John Smith, the chief executive of BBC Worldwide, said the venture was a “historic partnership” between the BBC, ITV and Channel 4.

“The new service will contain some of the very best of the UK’s content for consumers to view in one place, which will be both easy to use and great fun,” he added.

The BBC and ITV’s on-demand services launched earlier this year, with the commerical broadcaster initially concentrating on soap opera catch-ups.

Channel 4’s service offers hundreds of hours of programming from current series such as Ugly Betty to classic shows including Father Ted. Other on-demand services are offered by other providers including Five, Sky, BT Vision and Tiscali.

The Oulu City Theatre in northern Finland, 373 miles (600 kilometers) north of Helsinki, says it is the world’s first cultural institution to use the hippest handset technology, expected to turn mobile phones into wallets.

NFC (near-field communication) technology is activated by waving phones over wireless readers, or smart tags, and is widely used in public transport access cards.

The theatre is running a pilot, involving technology from Finnish mobile phone-maker Nokia and telecommunications operator TeliaSonera, until the year-end and will extend its usage more widely if it proves successful. More at Reuters.

The combination of a Sony proprietary high-resolution algorithm with “quality of service (QoS)” enables simple, real-time broadcast of high-resolution video.

The current exhibition features a new dual FOMA feature that enables video to be transmitted by simultaneously using two FOMA handsets. Using one FOMA handset, the theoretical bandwidth is 384 kilobits/second, with actual speeds reaching about 256 kilobits/second. With the dual FOMA feature, these speeds reach 450 to 480 kilobits/second to enable stable 15 frames per second of H.264/AVC video.

The Location Porter is available through a rental service starting at a two-week rental period. It is easy to use and takes advantage of the latest features of PCs with their ever advancing functionality.

Sony Finance will be offering the rental service. The rental fee for two weeks is $1360 (¥149,800 yen). The Location Porter will enable simple live broadcasts not only for professionals but also for businesses and the general public.

UN Aid Agency - World Food Program - Seeks YouTube AdsROME — The United Nations’ food aid agency has called on budding film-makers to help it raise awareness of hunger and bring the reality of abject poverty and suffering to the “YouTube” generation, Reuters reports.

The World Food Program (WFP) launched a contest on Wednesday for “edgy 30 or 60 second video(s) that will make the online community buzz about global hunger”, it said.

“For those of us doing the day-in, day-out backbreaking work of getting food to hungry people, it’s sometimes discouraging how few people understand that hunger stalks and kills a child every five seconds,” said WFP communications director Nancy Roman.

The five best films will be posted on the WFP’s YouTube site, with the overall winner receiving a trip to one of the agency’s relief operations.

Filmmakers stand a better chance of winning if they get play on blogs or networking sites like Facebook or MySpace before the competition’s July 2008 deadline, WFP said.

The agency has posted its own video at its site YouTube.com/hungerbytes, which shows footage of people in eating competitions bolting down hotdogs and plates of spaghetti, accompanied by The Beatles’ song “Piggies”.

Tech-On! further writes, “Based on Olympus’ proprietary “axisymmetric free-form-surface lens” unveiled in July 2007, the prototypes have enhanced resolution and widen viewing angles. The lens had 760 scanning lines and a vertical viewing angle of 45° when it was first announced in July. The resolution and the viewing angle were achieved by optimization of the imaging optics (lens group) including the axisymmetric free-form-surface lens, the company said.

The lens is shaped like a top with a diameter of about 6cm. It is made of plastic. It can form omnidirectional images (horizontal and vertical viewing angles of 360 and 50°, respectively) on a plane surface in an annular manner, or project annular images on an omnidirectional surface.”

Brussels – November 20, 2007 –The European Commission has imposed a total of $109 Million (€ 74,790,000)  fines on Sony, Fuji and Maxell for fixing prices for professional videotapes sold to customers in Europe, in violation of the EC Treaty’s ban on cartels and restrictive business practices (Article 81).

Between 1999 and 2002, Sony, Fuji and Maxell managed to raise or otherwise control prices through a series of regular meetings and other illicit contacts. Sony’s fine has been increased by 30% for obstructing the Commission’s investigation during on-site inspections at its premises.

Fuji’s and Maxell’s fines are reduced by 40% and 20% respectively because they co-operated with the investigation under the Commission’s 2002 Leniency Notice. There was no immunity applicant in this case. For the calculation of the fines, the Commission applied for the first time its new 2006 Guidelines.

Competition Commissioner Neelie Kroes said: “This decision sends two warnings to companies engaging in cartel activities: first, the Commission can prosecute cartels effectively even without prompts from immunity applicants, and second, obstructing a Commission’s antitrust investigation leads to severe penalties.”

The Commission started an investigation on its own initiative with surprise inspections, carried out at the premises of Sony’s, Fuji’s and Maxell’s European subsidiaries in May 2002.

The inspections proved particularly successful as abundant evidence of cartel activities was found. However, a Sony employee refused to answer oral questions asked by the Commission’s inspectors, in breach of Sony’s obligation to answer, while another Sony employee was found to have shredded documents during the inspection.

Fuji and, at a later stage, Maxell co-operated with the Commission and submitted additional evidence. Sony only acknowledged its involvement after receiving the Statement of Objections.

The cartel
The cartel covered the two most popular professional videotape formats at the time of the infringement: Betacam SP and Digital Betacam, which in 2001 totalled annual sales of some €115 million in the European Economic Area (EEA). TV stations and independent producers of TV programmes and advertising films are the main customers of professional videotapes.

Sony, Fuji and Maxell, with a combined share of more than 85% of the professional video tape market, organised three successful rounds of price increases and endeavoured to stabilise prices whenever an increase was not possible. They also regularly monitored the implementation of the price agreements.

The evidence uncovered describes in detail eleven meetings during which Sony, Fuji and Maxell discussed and agreed prices and/or exchanged sensitive commercial information as well as continuous contacts intended to monitor the implementation of their cartel agreements.

Fines
This is the first Commission antitrust decision where the 2006 Guidelines on Fines have been applied . Under the new method, fines better reflect the overall economic significance of the infringement as well as the share of each company involved.
